Terms Of Service

Terms of Service for Commission

By commissioning Adakkin, also referred as “Adakkin y ARKS” and “ARKS”, you are stating that you have read and agreed to these terms.
“Adakkin” refers to the company, services, and brand.
“ARKS” or “Adakkin By ARKS” refers to the owner, sole-proprietor, and entity of Adakkin.________________________________________Basic ToS:
● Payment expected within 24hrs
● Do not send payment until requested*
● Commissioner can re-upload the image with credits given to Adakkin or ARKS
● Artwork cannot be used commercially, or claimed as your own
● Customers must be 16 years or older. It is expected that a legal parent or guardian has read and accepted these terms.*
● All payments must be made using USD through Paypal*
● Art is NON-refundable once finished.*
● Art is 30% refundable BEFORE Line-Art begins.*
● Rush orders are not accepted*In Depth ToS:SECTION I. IMAGE COPYRIGHT1. Adakkin retains full and exclusive rights to the original artwork under the titles “Adakkin”, “ARKS”, or “Adakkin by ARKS” . The client may not claim it as their own or use it for anything other than personal use.
2. All commissioned artwork is for noncommercial purposes only. Redistribution of artwork for use in printed merchandise or as promotion of goods, services or social media pages is prohibited.*
3. Conditions for Reposting3.1. The client has permission to repost the artwork wherever they would like, as long as proper credit is given and the watermark/signature remains intact and unaltered.
4. Prohibited Actions4.1. Altering artwork in any way with the exception of cropping/resizing the image for an icon or other use.
4.2. Use artwork as references for your own, whether tracing or re-purposing parts of the image.
4.3. Claiming the artwork as your own.
5. ARKS claims advertising rights to the artwork, unless otherwise stated by the customer, meaning ARKS may use the completed art to advertise commissions.SECTION II. PAYMENT INFORMATION1. Payment is accepted in USD. All USD payments will be taken via Paypal only.
2. You will be given 24 hours to pay after a quote is given.
3. Non-payment within 24 hours will result in the commission being cancelled.
4. It is the commissioner's responsibility to notify when the payment has been sent.
5. Refund Policy
5.1. If the commission is cancelled (by ARKS or the client) before work has started, then the client will receive a full refund.
5.2. If the client cancels the commission during progress, the amount refunded will be on a case-by-case basis and up to the artist’s discretion. The maximum refund is listed below:
5.2.1. Sketch: 30%
5.2.2. Not Started: 100%**
5.3. No refunds will be given for completed or nearly completed commissions.
5.4. The artist reserves the right to cancel a commission at any time, for any reason, and without explanation.SECTION III. CONTACT AND COMMUNICATION1. Discussion of commissions can be conducted via any official Adakkin user page or point of contact (i.e. Amino, Gmail, Instagram, or FIverr).
2. Visual Reference Guidelines2.1. Clients must provide at least one clear and concise visual reference; please supplement the visual reference with any important information needed to correctly draw the character.
2.2. If you link to a gallery of your character’s artwork, design interpretations may be inconsistent between images and lessen the ability to accurately draw your character. Shading on potential pieces will also play a part in this.SECTION IV. WILL/WON'T DRAW1. Below is a general guideline for what artwork Adakkin is willing to produce. Please keep art style in mind when ordering

3.4. Any sort of hateful content, such as racism, transphobia, homophobia, and characters with Nazi/Soviet/etc. imagery or paraphernalia.SECTION V. WORKFLOW PROCESS1. I work best when given a scene or pose that you have in mind, but please allow and expect some variation.
2. Estimated date to completion. If there are any delays in completion of a commission, the customer will be notified.2.1. If for any reason ARKS cannot complete a commission within 90 days of ordering, ARKS will issue a full refund.
3. A sketch will be sent for approval or alterations before finalization. Progress will be paused until the sketch is confirmed.
4. Revisions and edits. If the commission type includes a sketch approval stage, any major changes or revisions must be made at this stage; this includes any significant changes to a character’s pose or body shape, or redrawing parts of the image.4.1. After the sketch has been approved, no major edits or changes will be made. If the commissioner requests additional edits after the approved sketch, a price for the edits may be discussed.
4.2. If ARKS makes any errors in the character design, accessories, or any other visual elements specified in the provided visual references, these edits will be made at no additional cost.
5. ARKS uses Trello to track progress and completion of commissions in the queue. ARKS creates and provides a personalized Trello card that is updated in accordance to progress on said commission.SECTION VI. CHANGES AND ADDITIONS TO ToS
1. All changes to ToS are applicable to future purchases. Any other ToS not listed here or on the ARKS official Trello are considered VOID.*
2. Breach of this contract falls to the responsibility of the client, and it is the client's understanding and agreement to the loss of a refund or incompletion of the item or service purchased.
3. Settlements may be made within 1 year of claim and art to be settled by arbitration in Palm Beach county, FL.*
4. Sales are only valid on their respective platforms (i.e. $10 Off Sale for new customers on Furry Amino)
5. This is a living document. Changes will be marked with their date of implementation and are not applicable to past invoices.
SECTION VII. FIVERR ToS EXCEPTIONS AND CONDITIONS1. Fiverr clients are to abide by Fiverr ToS in conjunction with ToS stated here. Violations of ToS will result in cancellation.
2. Certain ToS stated here are VOID in conjunction with Fiverr ToS
3. Terms considered VOID in conjunction with Fiverr ToS are marked with a single asterisk*
4. Legal actions will be taken through Fiverr in the event terms are broken
SECTION VIII. PAYPAL ToS EXCEPTIONS AND CONDITIONS
1. Clients are subject to PayPal terms of conditions in conjunction with ToS stated here.
2. Terms considered VOID in conjunction with PayPal Tos are marked with a double asterisk**
3. Legal actions will be taken through PayPal in the event terms are broken
4. Refunds do NOT include PayPal Service Fees
5. Payment will be received in USD through PayPal invoice or goods and services.
6. Disputes must be communicated between ARKS and the client before a PayPal claim is made. Failure to do this will result in third party legal action.
